Treatment of Kelly in Spotlight
LONDON -- The Ministry of Defense's top civil servant is facing questions at the Hutton Inquiry about the way Dr. David Kelly was treated in the weeks before his death, BBC said.

The inquiry into the death of weapons expert Dr. Kelly - the source for a BBC report claiming the government exaggerated intelligence on Iraq - is hearing from the ministry's permanent secretary Sir Kevin Tebbit.

He is being questioned on the strategy which led to Kelly being publicly named as the BBC's possible source, as well as on the way the scientist was made to answer MPs' questions.

Later, the prime minister's two official spokesmen, Godric Smith and Tom Kelly, are due to take the stand at the Royal Courts of Justice.

Opening his evidence, Sir Kevin said he had taken no direct role in producing the Iraq dossier.

But after the controversial BBC story he had asked the MoD's defence intelligence chief to remind staff about their obligations in an effort to establish whether there were suspicions about leaks.

The Whitehall mandarin said there was a history of leaks from what was a large department containing the three armed services. "There have, from time to time, been suggestions of rivalry, of putting information into the public domain to support one particular interest against another, something which I deplore, the chief of staff deplores and so does the secretary of state."

It was also already known that BBC correspondent Andrew Gilligan had unauthorized contacts with MoD officials, he said.

When on 18 June he was told that Kelly had spoken to the BBC reporter recently, it was agreed those contacts should be discussed with the scientist.

But the initial planned interview on 24 June was postponed because it could have clashed with a separate investigation into the leak of a top secret document - of which Kelly was later cleared.

Kelly was eventually interviewed after he had written a letter on 30 June admitting his contacts with Gilligan.

Sir Kevin said he had wanted MoD personnel director Richard Hatfield to question the scientist "as coolly as possible" saying that Hatfield was not one of the "people who were themselves caught up in the intense political issues of the moment".

It needed to be established whether there was a case for disciplinary action, he said. But he was not aware that Defense Secretary Geoff Hoon had suggested to Downing Street press chief Alastair Campbell the idea of a "plea bargain" as a way to get the bottom of Kelly's media links.

Tuesday's hearings saw Campbell criticize the MoD strategy which led to Kelly's name being published.

The MoD first produced a press release on 8 July saying an unnamed official had come forward and admitted speaking to BBC correspondent Andrew Gilligan. Just over 24 hours later they confirmed Kelly's name to journalists.

In hindsight, the government scientist could have had better "proper support" from the media spotlight if his identity had been announced "cleanly", said Campbell.

Campbell said he could have argued his point more vigorously but was ordered by Tony Blair to take a back seat and let the MoD take the decisions.

After Kelly was named, Sir Kevin advised that the scientist should not have to appear in public before the Commons Foreign Affairs Committee - but was over-ruled by Hoon.

Kelly was found dead, apparently after committing suicide, three days after the televised committee hearing.

Later on Wednesday, Downing Street spokesmen Smith and Kelly were likely to shed more light on Number 10 media operations.

The pair were involved in discussions about how to deal with Kelly once he had come forward.

Tom Kelly has already had to apologize to Kelly's widow for describing the respected scientist and former UN weapons inspector as a "Walter Mitty" fantasist.
