TOKYO (AFP) - Japan's top court has a damages suit brought by South Koreans forced to work as sex slaves or soldiers by the Japanese Imperial Army, saying their suffering in World War II cannot be compensated under the post-war constitution.

The Supreme Court ruling infuriated some plaintiffs, who climbed over the barrier separating them from the judges and court secretaries and roared in anger, Japanese news reports said.

The 35 plaintiffs, including relatives of Koreans who died, had demanded Tokyo pay them 20 million yen (194,400 dollars) each for their suffering during Japan's colonization of the Korean Peninsula between 1910 and 1945.

The suit was originally brought in December 1991 by three former South Korean sex slaves, the first such victims to shed light on their plight after staying silent for decades out of shame.

The women recounted servicing troops in wartime brothels and their suit was joined by men who said they were forcefully drafted into the Japanese army and sent off to war.

But Chief Judge Osamu Tsuno upheld lower court rulings rejecting their case and said the suffering of former soldiers had "stemmed from World War II and (Japan's) defeat."

"Compensating for this was far beyond what the constitution could foresee," Tsuno said.

The judge also dismissed compensation for the former sex slaves, euphemistically called "comfort women", noting they suffered damage before Japan's US-imposed constitution took effect in 1947.

The ruling also said the plaintiffs lost the right to claim redress under a 1965 bilateral agreement restoring relations between South Korea and Japan in which Tokyo agreed to lend money to the neighboring country.

Japan's refusal to apologize formally for atrocities during World War II mars relations with its neighbors six decades later.

China and South Korea have both reacted angrily to Prime Minister Junichiro Koizumi's repeated visits to a Tokyo shrine dedicated to Japan's 2.5 million war dead including 14 notorious war criminals.

Japan's Education Minister Nariaki Nakayama said this weekend he was relieved current Japanese textbooks have cut back on a "self-tormenting" view of World War II.

"There was a time when Japanese textbooks were full of nothing but extremely self-tormenting things saying that Japan was bad," Nakayama told a town hall meeting in southern Oita prefecture on Saturday, according to newspapers.

"We have tried to correct that," he was quoted as saying.

"I'm really glad that recently there are fewer words such as 'comfort women' and 'forced relocation' used in textbooks," he said.

Historians say at least 200,000 young "comfort women," mostly from Korea but also from Taiwan, China, the Philippines and Indonesia, were forced to serve as sex slaves in Japanese army brothels during the war.
