In 2007, along with the other rights obtained by Romania and Bulgaria’s integration into the European Union, the citizens of the two countries now have full freedom of movement in the community space. With only the identity card, needing no visa, Romanians and Bulgarians left in large numbers to visit places that before had been off limits for them. Some went on vacation, or to illegal work. Others went to steal or beg. Most of the latter are Roma, who live in makeshift camps on the edge of large European towns. Occasionally they make the headlines with the crimes they commit, and don’t want to get back to their countries of origin.

“In Romania I expect to eat once a day. In Finland it’s three times a day”, says a Romanian man of Roma origin, according to a report by the European Agency for Fundamental Rights. According to statistics, Roma make up about 10% of the population of Romania and Bulgaria, and 80% of them live on less than four dollars a day; their life expectancy is 10 to 15 years less. The large sums of money received from the EU since 2003 for Roma inclusion did not manage to solve much. The recent initiative by France to repatriate Romanian and Bulgarian Roma has inflamed the EU and the UN, and has shown very clearly that a common solution at European level is needed for the Roma issue. Political analyst Cristian Parvulescu:

“European Justice Commissioner Viviane Reding made a very tough statement about France’s policies with regard to this issue. Her statement started first and foremost from an ordinance issued by the French Ministry of the Interior on August 5th. The fact that that ministerial ordinance was aimed at an ethnic group with no other association made the European Commission consider that a violation of the European legislation”.


After an investigation by the judicial services of the European Commission, the European executive decided in principle to launch the infringement procedure against France in mid- October for the violation of the European law. That, however, will happen only if Paris does not submit strong guarantees to prove that its repatriation actions are not discriminatory. France thus has a de facto grace period to avoid the procedure, but it is under the guillotine, as a member of the Commission put it. Here is the president of the European Council Herman van Rompuy:


“A member state has the right and duty to act towards maintaining the rule of law on its territory. On the other hand, the Commission has the right and duty to oversee compliance with the community law in member states”.


Authorities in Brussels have recalled that the social and economic integration of the Roma is a challenge and a responsibility of all EU member nations. This year, more than 8300 Roma have accepted monetary compensation in return for leaving French territory. Adults have received compensation worth 300 euros, while a child has been given 100 euros. This system, however, has proven inefficient, given that Romanian and Bulgarian Roma, as EU citizens, cannot be stopped from returning to French territory. The system has also proven expensive for the authorities in Paris, all the more so as one person can receive financial aid more than once. To eliminate this possibility, the French government has developed the Oscar system, a “Tool for Repatriation Aid Statistics and Control”, to be made effective this fall.

Officials in Romania, a coutnry directly involved in the Roma issue, believe that those repatriations infringe the civil rights and liberties of EU citizens, including the right to free movement within the Union and equal treatment of all community citizens, regardless of race and ethnic origin. The Romanian government stands for a strategy to be worked out for the integration of the Roma at European level, as the nomadic Roma people are an issue that affects all nations, not only their countries of origin. Here is what Romanian president Traian Basescu said:


“We need to find an intelligent solution in order to provide the Roma with the possibility of earning an honest pay and access to education for their children, while observing their right to free movement and as long as they don’t commit any crimes. I wish to add that apart from having the possibility to work, they must also show will to do so.”


Meanwhile, the European Commission will asses the manner in which national and community funds allocated for the Roma issue have been used, and will suggest ways to improve the productivity of social welfare programs for ethnic Roma. Analyst Cristian Parvulescu draws this conclusion:


“The Roma issue, from the bilateral agenda of Romania and France, was eventually placed on the European agenda. This October, Bucharest will host an international conference on the topic.”
